The Constitution gives Sates this “police power” under the 10th Anendment, so its usually the States carrying out the acts. Below is a brief explaination. It’s from Wiki, which isn’t the best source, but it’ll suffice; In United States constitutional law, police power is the capacity of the states to regulate behavior and enforce order within their territory for the betterment of the health, safety, morals, and general welfare of their inhabitants.[ Usually the courts put a stay on something like that if it's challenged though.
