Can insurance companies discriminate against race?

Insurance companies set prices based upon the likelihood of a claim. Any prices are approved by the States Dept of insurance. They have to be justified based upon prior claims for that "class" of insured. 

 

Many things go into prices

 

obviously type of car and amount of insurance and deduct and blah blah blah

 

Other things that affect price

 

that specific individuals driving , credit, criminal record

 

that drivers age. if a youth their grades and parents prior claims

 

that drivers sex

 

that drivers address some areas are much more prone to hit and run as well as theft or vandalism

 

Race is not asked nor provided to the insurance company.

Same reason you cant have a black section at a restaurant pal.

 

 

 

2 potential reasons

 

No study has ever shown that probity of claim is based upon race

 

It's against the law

 

 

it is also against the law to discriminate against sex.  Yet insurance companies do.  Same with age.

My guess is WVU thinks blacks have more claims than whites.

 

I have never seen a study that shows if a white and a black male age 27 live in area 55555 and have clean priors that the black is more or less likely to have a claim
